Email Slander

Although slander actually refers to oral defamation, many people these days use email in place of making a phone call. When a squabble exists between two parties, and the verbiage gets nasty, this is treated as defamation and can have serious legal ramifications. Those who hide behind anonymous emails, blogs, Facebook accounts, and and other social media have become quite adept at attacking anyone they please.

When you receive an email that crosses the proverbial line, you have received communication that is considered as defamation of character. As the communication was sent directly to your email address, there is no question that the offending party had anything other than, at least, malicious intent.

You may then ask, who do I know if a communication is indeed defamatory in nature. By definition, slander, a type of defamation clearly exists when something said about you is simply false. If the email went out to, or was seen by more than ten other people, again, it’s defamation. There are accusations that are in and of themselves slanderous in and of themselves. These include your being referred to as being sexually deviant, a criminal, or incompetent to perform your work duties. Even accusing you of having some horrible disease, communicable or not, is slanderous.

Although the information above is not all-inclusive, and not all cases actually turn out to be slander, examining the contents of correspondences you have received with remarks such as these will tell you, more often than not, if you have an email slanderer on your hands. Yes, everybody is entitled to their First Amendment right of freedom of speech, but some just go too far and cross the line.

If you are experiencing email defamation, or any other types of internet attack that is defamatory, you do have recourse. Many things can be done, from something relatively benign such as contacting the offender letting them know that you know who they are and that you plan to do something about it. The most extreme measure, when other remediation is impossible is to actually file a lawsuit.

Whether or not you can identify one specific ‘attacker’ you are unlikely to find them all. In order to pursue the matter you have to be able to prove the identity of the person slandering you.
